GSF.Connect Platform Access Terms and Conditions
Thank you for choosing to have yourself or your child gain access to Girl Shaped Flames’ GSF.Connect digital platform. By applying for access, you agree that you and your child will be bound by these Access terms and conditions. You agree that you will make your child aware of these terms and conditions and ensure that they also comply with them.
1. DEFINITIONS
In these terms and conditions the following words will have the following meanings:
“Event(s)” means any event organised by GSF;
“GSF.Connect Website” means the website at gsfconnect.com.au;
“Platform” means the digital platform hosted at gstconnect.com.au;
“Members” means any person with access membership to GSF.Connect;
“Access” means access to GSF.Connect;
“Access Fee” means the fee which must be paid in order to gain Access to the platform;
“Terms” means these access terms and conditions;
“we, our or GSF” means Girl Shaped Flames Pty Ltd ATF Meessmann Family Trust;
“you or your” refers to the individual purchasing the Access; and
“your child” means the child you are the parent or guardian of.
2. YOUR APPLICATION
2.1 Applications for Paid level Access must be made by a consenting parent or guardian through the GSF Website.
2.2 You must ensure that all the information you provide about you and/or your child is accurate and up to date.
2.3 GSF reserves the right to reject any Access application at its sole discretion.
2.4 our or your child’s Access will not be complete until you receive a confirmation email from GSF accepting your Access application.
3. ACCESS CONDITIONS
3.1 There are a number of benefits granted to those who have Access, and a full list can be found on the GSF Website.
3.2 You agree and acknowledge that GSF may periodically change the Access benefits.
4. ACCESS FEE
4.1 You agree that in return for the Access, you will pay the Access Fee for each year or month of Access as set out on the GSF Website. The Access Fee is not refundable.
4.2 GSF may, at its sole discretion, offer a refund of the Access Fee on a case-by-case where it believes special circumstances exist. Please contact GSF if you believe that to be the case and GSF will review the circumstances of your request for a refund.
4.3 GSF reserves the right to periodically change the Access Fee, and will give you notice of at least one month prior to doing so.
5. RENEWALS
5.1 You agree that your child’s Access will automatically renew at end of each year of Access, and authorise the use of the credit card used to purchase the Access to do so. You will let us know if you prefer to pay with an alternative card.
5.2 If you wish to terminate the Access so it does not renew, you will give GSF a minimum of two weeks notice prior to the Access renewal taking place.
6. EVENTS
6.1 You agree that you and your child, when attending or participating in an Event (including live video streamed events and participation in the GSF Community Forum), shall comply with the Event’s terms and conditions that will be available on the GSF Website. You will ensure that your child’s behaviour at any Event is in line with clause 8 of these Terms.
7. PRIVACY POLICY
7.1 Any personal information provided during the application for Access or as a Member will be treated in line with our Privacy Policy, which you may find on the GSF Website. By your child gaining Access, you consent (and where relevant, will attain your child’s consent), to the uses of personal information as set out in the Privacy Policy.
8. BEHAVIOUR
8.1 You agree that you and your child, as part of the Access and at Events, shall not engage in any behaviour that is or could be viewed as abusive or harassing. You also agree that you and your child shall not act or encourage others to act in a way that is unlawful, defamatory, discriminatory or could otherwise reasonably be viewed as objectionable.
8.2 You agree that you and your child shall not send unwanted or spam communications to other Members.
8.3 You agree that GSF is in no way responsible or liable for the behaviour of other Members or of your child.
8.4 GSF may cancel your or your child’s Access at any time where it feels you or your child’s behaviour or conduct breaches these Terms or brings GSF into disrepute.
9. INTELLECTUAL PROPERTY
9.1 You agree that any and all intellectual property rights which are created as part of the Access shall be the property of GSF.
9.2 You agree that any materials or content created or used by you or your child does not infringe any third person’s intellectual property rights.
10. RELEASE
10.1 You agree that GSF shall have the right to use photographs, videotapes, or images of your child and/or audio recordings of your child which are made by GSF at Events, through its employees or agents solely for GSF’s use including, but not limited to, placing the materials on GSF’s Website, in any publication or generally for the promotion of GSF. You grant GSF an irrevocable, royalty-free, perpetual, non-exclusive license to use, display, publish, exhibit, and distribute all or portions of the photographs, videotapes, images or audio recordings from the Events.
11. LIABILITY AND INDEMNITY
11.1 As far as permitted by law, GSF excludes any warranties or conditions regarding your Access. Other than where liability cannot be excluded or limited by law, you agree that the maximum liability of GSF to you will be the amount of the Access Fee.
11.2 You shall indemnify and hold harmless GSF from any claim, demand, loss, liability, damage or expense arising in any way from the conduct of you or your child other than where directly the result of the negligence or wilful misconduct of GSF.
12. ENTIRE AGREEMENT
12.1 It is agreed by the parties that these Terms form the entire agreement between them. Developments by GSF may necessitate that we review and revise the Terms from time to time. We recommend that you review this page at regular intervals to ensure you are up to date with the latest version of the Terms.
13. SEVERANCE
13.1 If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms.
14. LAW AND VENUE
14.1 These Terms shall be governed by and construed in accordance with the laws of Queensland. The parties submit to the exclusive jurisdiction of the Queensland Courts.
